{"id":3238,"date":"2019-05-16T20:03:15","date_gmt":"2019-05-16T20:03:15","guid":{"rendered":"https:\/\/www.riscreen.de\/?p=3238"},"modified":"2019-05-16T20:03:15","modified_gmt":"2019-05-16T20:03:15","slug":"cookie-banner","status":"publish","type":"post","link":"https:\/\/riscreen.de\/en\/cookie-banner\/","title":{"rendered":"Cookie banner"},"content":{"rendered":"\n<p>In its activity report in <a href=\"https:\/\/www.lda.bayern.de\/media\/baylda_report_08.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">chapter 8.3 &#8220;Cookie banners&#8221;<\/a> on page 55, the BayLDA points out that many cookie banners often do not provide the customer with all the necessary information so that effective consent can be obtained.<\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"to-obtain-effective-consent-the-following-requirements-should-be-met\">To obtain effective consent, the following requirements should be met:<\/h2>\n\n\n<ul class=\"wp-block-list\"><li>When the website is opened, a banner appears with all the processing operations requiring consent, including the actors involved. Here, the customer must be able to make the selections independently without default settings.<\/li><li>First of all, the banner blocks all scripts on a website that could collect user data.<\/li><li>Data processing may only take place after the customer has given active consent (no default settings!).<\/li><li>The giving of consent may only be stored for evidence purposes. However, indirect identification of consent by the customer as evidence is permissible and sufficient.<\/li><li>In addition, there must be a possibility for revocation.<\/li><li>It should be clarified that the consent does not only cover the use of cookies.
